To enable MLS®-related functionality, you must hold a valid real estate license, provide a valid Agent ID (or Member Code), and have any consent required from your local real estate board, brokerage, or other applicable authority to enter into this agreement.
To enable MLS®-related functionality, you may be required to sign a copy of an MLS® Reciprocity Salesperson Agreement, Member Website Broker Approval Form, or equivalent document, depending on the requirements of your real estate board, brokerage, or other applicable authority.
You take on full responsibility for following all applicable MLS® rules, regulations, guidelines, and local laws.
You take on full responsibility for following all applicable real estate council rules, regulations, and guidelines, including those governing how your name(s), brokerage(s), office(s), or team name(s) are displayed on your website.
Nano Technologies reserves the right to disable or delete your account, without warning, if your website is made available at a full domain name without proper payment being set up on your account (including forwarding a full domain to a Nano Technologies temporary subdomain, with or without domain masking).
You must be a human. Accounts registered by bots or other automated methods are not permitted.
You must provide your full name, a valid email address, and any other information requested in order to complete the signup process.
You are responsible for maintaining the security of your account and password. Nano Technologies cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.
You are responsible for all content posted, and all activity that occurs, under your account — including content posted by others who have access to your account.
You may not use the Service for any illegal or unauthorized purpose, and must not violate any laws in your jurisdiction in connection with your use of the Service (including, without limitation, copyright and anti-spam laws).

Customer Support

Nano Technologies provides standard customer support at no additional cost. Nano Technologies will determine, in its sole discretion, whether a given support request falls outside the scope of standard support; if so, you will be notified and presented with a time/cost estimate, alternative solutions, or a refusal.

Nano Technologies may provide an assisted setup or migration service covering a limited amount of initial content on your website. Nano Technologies will determine, in its sole discretion, whether a given setup or migration request falls within the scope of this free service; requests requiring additional work will be quoted separately.

Payment, Refunds, Upgrading and Downgrading Terms

A valid credit card (or other accepted payment method) is required for paid accounts.
If you sign up for a free trial, your website may be made available on a temporary subdomain (such as name.[DOMAIN_PLACEHOLDER]). To launch your website at a full domain name, you must first set up payment on your account.
Your payment method will be billed on a monthly or yearly basis, depending on the plan you select.
The Service is billed in advance and is non-refundable. There are no refunds or credits for partial periods of service, upgrade/downgrade differences, or unused time on a paid account, except as required by applicable law.
All fees are exclusive of applicable taxes, levies, or duties, which you are responsible for paying.
If you upgrade or downgrade your plan, your payment method will automatically be charged the new rate on your next billing cycle.
Downgrading your Service may result in the loss of content, features, or capacity associated with your account. Nano Technologies accepts no liability for such loss.
If your payment method cannot be processed or your account becomes delinquent, we will attempt to notify you and provide a grace period of [GRACE_PERIOD_PLACEHOLDER] to update your payment details. If payment is not received within that period, your website may be locked, made unavailable, disabled, or deleted until payment is resolved. Nano Technologies accepts no liability for such loss.

Cancellation and Termination

Nano Technologies reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part of it) with or without notice.
Prices for the Service are subject to change with at least 30 days' notice, posted on our website or communicated through the Service itself.
Nano Technologies will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.

Copyright and Content Ownership

All content posted on the Service must comply with applicable Canadian copyright law.
We claim no intellectual property rights over material you provide to the Service. Your profile and uploaded materials remain yours; however, setting pages to be shared publicly means you allow others to view and share that content.

The look and feel of the Service is the copyright of Nano Technologies. You may not duplicate, copy, or reuse any portion of the underlying HTML/CSS or visual design elements without express written permission.
The web design, programming, backend code, included libraries, and technical processes are owned by Nano Technologies and its licensors. You do not own any part of the website template, design, or platform code, except for content you personally developed and added to your account.

General Conditions

Your use of the Service is at your sole risk. The Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including merchantability, non-infringement, or fitness for a particular purpose.
Nano Technologies uses third-party vendors and hosting partners to provide the hardware, software, networking, storage, and related technology required to operate the Service.
You must not modify, adapt, or attempt to hack the Service, or create another website that falsely implies association with Nano Technologies or the Service.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission.
We may, without obligation, remove content or terminate accounts containing content we determine, in our sole discretion, to be unlawful, offensive, threatening, defamatory, or otherwise in violation of these Terms or any third party's rights.
Abusive conduct toward any Nano Technologies customer, employee, or officer (including threats) will result in immediate account termination.
You understand that data transmitted through the Service may pass over various networks and may be transmitted unencrypted at points, and may be adapted to meet technical requirements of connecting networks or devices.
You must not upload, post, host, or transmit unsolicited email, SMS, or "spam" messages, in compliance with Canada's Anti-Spam Legislation (CASL) and other applicable laws.
You must not transmit worms, viruses, or any code of a destructive nature.
If your bandwidth or resource usage substantially exceeds typical usage among Nano Technologies customers (as determined by us), we may notify you and take reasonable action, which may include limiting hosting, applying additional fees, or disabling the affected account, after providing notice.
Nano Technologies does not warrant that the Service will meet your specific requirements, be uninterrupted, timely, secure, or error-free, or that results obtained through the Service will be accurate or reliable.
Nano Technologies is not a domain registrar. You are responsible for renewing your domain name with your registrar, and your website may become unavailable if your domain lapses.
Nano Technologies has no control over third-party search engine policies or algorithms, and is not responsible for changes to your website's search ranking.
To the extent permitted by law, Nano Technologies shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from your use of, or inability to use, the Service. If Nano Technologies becomes liable to you despite this limitation, that liability is limited to the fees you paid in the 3 months preceding the event giving rise to the claim.
Failure by Nano Technologies to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. These Terms constitute the entire agreement between you and Nano Technologies regarding the Service, superseding any prior agreements.
